Day 83

It has been nearly three months since Dale Mallory cleaned out and closed down the West End Community Council bank account, months after being impeached and removed from his office as president of the WECC.

If you aren't familiar with this affair, you can view the timeline right here.

Here is an update on what has happened since the last time we broached the subject:

1) Not one thing.

Thanks for checking in, I am sure we will have more updates later.

Now a cynic might say that this investigation is over. In reality, it hasn't even started. A complaint was filed by the WECC treasurer, Maggie Moon. That complaint went to the Cincinnati Police. The CPD never opened a formal investigation. They never asked bank officials for records. They never interviewed anyone involved in the West End Community Council. When concerned parties got around to asking the question why?, the CPD stated that they were handing the investigation over to the FBI for another reason: They had an apparent conflict of interest with Dale being the Mayor's brother.

The FBI was given the case. They have had it for about a month. Has the bank been contacted? Has the WECC been contacted? Sources have confirmed to me that this hasn't happened. You would think at the least a perfunctory gesture would be done to admonish them of having to really take action, but they can't even fake it.

Pathetic.

At some point, I expect the CPD and the FBI to close out the complaint and tell people the case is now closed. In a way, it already is.

If the Hamilton County Democratic Party wanted to replace Dale Mallory on the ticket, that deadline is a week and half away. Since no investigation has been started in the last three months, the chances that an investigation will both start and find something in the next week and a half is very little. Dale Mallory is in the clear. He will be on the ticket and can't be removed.

At a later date, Dale could be indicted on felony charges for embezzlement, or passing bad checks (which he should be), but nonetheless he will be on the ballot. Given the nature of the 32nd District, that means that Dale Mallory is going to the State House.

We have two options now:

1) Dale’s case gets closed out, and he moves on to the State House.
2) Dale gets indicted for a felony, and he moves on to the State House.

Our goal was actually much different 83 days ago. We wanted the crime he committed to be prosecuted. We wanted Dale’s felony to be both indicted and convicted. Dale Mallory would have never made the statehouse. He would have been going to the big house.

That didn’t happen. People were advised by the CPD to be patient while they conducted an investigation. That investigation never happened. Right now we are being patient with the FBI, and that isn’t happening either. They have done nothing. Nobody has lifted a finger since the original complaint was filed. He is untouchable.

They don't try to tell us why. There are no explanations, and there is no investigation.

Just another day, Day 83.

Why not meet with Deters?

Why are the police the only ones saying THEY have a coflict of interest? And with the Mayor? Either's capacity is to serve the interests of the citizens, to serve and protect. This is shaking off the responsibilities that they have capacity to do.

Perhaps this is why the Mallory network does not include citizens in its investment in neighborhoods. Could be that the isolation makes people feel we will go away. We will not. COuld we get a meeting with Chief Streicher and the neighborhood? Could we get other communities to help us with such a meeting? This is beyond reason. Our community of citizens are asking for help and investigation and the POLICE ARE AFRAID??? Our cops are having to assess political waters before they go in.........then we need to provide them the backup needed.

The alliance of the Dems and Reps are so entwined only a genius could unravel collaborative collusion of these intelligent clowns. Working on the angle of
taking it to the streets.

From another's view, I play grass volleyball, but my rubber duck has been known to participate on the water as a mean front line spiker.
No wonder he's been missing in action at the tub; hanging out with the big dogs. Wolverine is my Pops; I'm just a junior.

We aren't giving up on this. Too many people have been injured in one way or another. Plenty of hours have gone into doing the research. We have a case. That is clear.

Perhaps Anon 7:28 has a good point - see Deters & his senior boys.

The Mallorys are NOT untouchable. We have already pierced the veil of their decades of deceptive practices. This is something no one else has ever accomplished.

Do not be deceived. Deters is more concerned with personal (his own) and politically expediency.....not the expediency for the citizens.

Not that he is not a nice and good man and believes in what he does, he is a politician that makes his living as an attorney/prosecutor, always with one eye out for the next race or keeping up apearances. that does not always include what citizens might need in anycrime or violation. Let's make sure as we go from one to another we realize that, as citizens, we are always politically expendable.....unless it's election time......ooohhhhh the tick, tick, tick is getting faster,

Anon 7:28, good question. I'll be waiting for a response, too. It's very discouraging that TS has poured so much time and effort into this debacle for what seems like no response. Now I realize just how powerful and well connected they are. Very suprising that not even the FBI seems willing to touch it.

You should have contacted Deters and Jim Petro long ago. If you haven't done that, do it now.

Talked with people today. The consensus is Jail4Dale is guilty as homemade sin. The suggestion I was given is "take it to Deters".

Yeah, Deters is a politician. Yeah, Deters is about image.
And no, the Truth Squad isn't disposable like paper towels.

Get the timeline & all the proof positive in solid order. As I mentioned in a previous post, think $1,000 a second in attorney's fees. Vlad has the names of 2 of Deters' top boys. Go in there with your guns loaded & with the position of determination & taking care of business. It's not Beer O'Clock.

Send the A-Team to Deters. Send the B-Team to Chief Streicher. Send the C-Team to City Hall. If the Federales are going to let their G-men drag their feet, it's time to blanket all local offices. Actually, once the A-Team goes to Deters' office, they should stroll down Main Street to the FBI Office & talk with those G-men.

This isn't going down the tubes. The Truth Squad Special Forces has put too much time in this. Their independent researchers have a lot of buy-in.

I believe if you put the call out to the neighborhoods, people will jump on board, even if to fill the seats at a meeting to show a united effort.

There's no way these Mallorys are that confounded invincible. Oh no. We mere mortals pulled the mask of deception off the entire gang!

Deters isn't as bad as everyone makes him out to be. Last Summer, I was able to get on his calendar for an hour meeting & plenty was accomplished. Got all my questions answered. One of his top guns told me to call or Email him any time with questions & concerns. Believe me, I've done it & got results. Basically, if you scratch the backs at the Prosecutor's Office, they'll massage your feet & make you feel great. Just give 'em everything they need.

And the bad news is Timbo the Bimbo hasn't made a sound about kicking Jail4Dale to the curb.

And everyone has seen this head lining news break this morning:

http://news.enquirer.com/apps/pbcs.dll/article?AID=/20060811/NEWS01/608110396

wtf 10:08 PM: I said no such thing. Go back & re-read what I wrote. I believe I didn't say anything about favors or proclivities.

Have you ever heard of cooperation? There are times you've got to give something to get what you want. In this case, the giving is the information & team investigative reports. The getting is an indictment that is going to stick to Jail4Dale like wet toilet paper.

Last I read here, this is a family-friendly blog & the politeness is to steer away from outrageous profanity, trashy comments & above all, everything that would point to racial remarks that offend.

Given that, I'm going to take your post as today's laugh. We have to laugh to keep from crying.

Go, Kimberly Hale! You're the girl!

Ballot swap puts heat on Mallory
Residency concerns drop Poast; Hale joins race in 32nd
BY KIMBALL PERRY AND GREGORY KORTE | ENQUIRER STAFF WRITERS
Facing concerns that his questioned residency may cost him the election, Mike Poast will drop out as the Republican candidate for state representative in Cincinnati's 32nd District, to be replaced on the ballot by Kimberly Hale.

Hale's entrance in the race also portends a more aggressive GOP attack on Dale Mallory, who was removed as West End Community Council president this year.

"Dale Mallory, with all of his problems," should be concerned, said Brad Greenberg of the Hamilton County Republican Party.

The 32nd Ohio House District is an open race; incumbent Catherine Barrett, D-College Hill, cannot run because of term limits. The district historically votes 3-to-1 Democratic and represents the central neighborhoods of Cincinnati, from Queensgate and Downtown along the river to College Hill and Hartwell on the northern city limits.

Mallory is the brother of Cincinnati Mayor Mark Mallory who, along with father William L. Mallory Sr., has represented the district for much of the last 40 years. The Mallory name was daunting, Poast said.

"I have a tough enough fight with someone who already has his name out there," Poast said.

But Mallory has been on the receiving end of attacks from his West End neighbors over his support of the CityLink social services center. Hale was part of a neighborhood coalition that removed Mallory from the community council post over the CityLink controversy.

The Enquirer later reported that Mallory, then a consultant for the Cincinnati Empowerment Corp., was billing the federally funded agency for his work on the project.

Hale's entrance into the race is likely to push that issue to the forefront of the campaign. She is president of the Dayton Street Association in the West End.

"I have a lot of optimism and a really strong grass-roots group of supporters," said Hale, 38, a business manager of a West Side graphic company who owns a real estate investment company.

Poast's campaign has been dogged by the question of whether he lives in the House district. He lived in College Hill when he qualified as a candidate but moved two months later to North College Hill.

When Poast went to vote for himself in the spring primary, he discovered election officials wouldn't let him vote in the race. Poast, 32, a cooking oil salesman, was told his house was just outside the district's boundary.

The GOP is expected to approve Hale as Poast's replacement, Greenberg said.

Hale Yesssssssssss!!!!

What is this about Kyhm Hale running against Dale? What is she thinking entering the race so close to election?
Can a woman really be effective against the Mallory name? As much as I dont want Dale to be elected I doubt very much that a woman joining late in the race stands a chance in Hale to win, There are only two ways that I believe that she can win:

1. If dale gets indicted in the next two weeks ( I doubt this will happen)

2. If the community unites behind Kyhm in an unprecedented way.

I think that law enforcement doesnt have the kanhunas to indict dale and I think the community is too lazy and uninformated to stand up and fight.

Please prove me wrong

Question....why not run as an Independent vs. a Repugnantcan? They're no better than the DemoCRAPS in this county---in fact WORSE on many levels.

The FBI said that they are not investigating the matter. They like to investigate public officials and large sums of money. Dale Mallory is not a public official. It doesn't hit their threshold or their own perceived jurisdiction.

The CPD wouldn’t investigate it for conflict of interest reasons. The FBI won’t investigate it because they view it as a matter for local law enforcement that is not elevated to the level of a federal case. The investigation is over.

At least Poast did the honorable thing by stepping down since he no longer lives in the district. (I wish other politicians were as honorable). You would think he would have researched that before he moved.

In any case, the Democrat solution is clear. Vote the Republican Candidate in 2 Years & boot 'em out. "2 in & Out"

Of course Hale might be a better candidate than Poast. We'll have to see what she has to offer.

Good message by westender100 on cincinnati.com:

Maybe Kim Hale will be the ONLY republican to win.
Look at the primary.
Poast and Barnes got about 1,000 votes each.
Bolton and Mallory got 2,000 votes each and the other 2 dems gor about 500 each.
Total 7,000 votes.
Mallory just got 28% of the primary votes.
Bolton spent $1.98/vote. Mallory spent $9.25/vote.
This was BEFORE Dale was found to be SELLING out his neighborhood for EZ/CityLink dollars.
This was BEFORE Dale was caught embezzeling WECC funds.
This was before the EZ fired Dale
This was BEFORE the FBI was asked to investigate Dale.
The world is learning that Dale is a very unemployed and unemployable thief.
Dale's only qualification is "I'm black and I'm a Mallory".
Kim was one of the first to discover the dirty game Dale played on his neighbors.
Dale's neighbors impeached him, tossed him out of office and prevailed over Dale's 2 frivolous lawsuits.
Hale Yes!!! Dale no.
Kimberly forever.....Mallory never!!!

"Dale Mallory is not a public official."

All the more reason why these law enforcement entities need to be hopping on him like flies at a family picnic.

The news is stating that the long arm of the law is holding off on Ernie Fletcher for his wrongdoings in Kentucky. Some stupidity about a public official can't be indicted while in office, something bizzare along those lines. The report was they'll wait until he gets out or is impeached, whatever.

Brava to Kimberly Hale! And yes, I believe this woman can pull this off. Shame on you, Tax Payer/Anon 10:32! Again, the voters in the 32nd have choices. I believe anyone who has a lick of common sense & is forthright will back this woman all the way to Columbus. It's very late in the game & she has tons of ground to cover. Luckily, for most women, they shine brightly when the pressure is on.

Go, Kimberly Hale! Hale will stomp Dale!

In addition, I hope you can get info from Kim Hale as to where she'll be running her campaign, so volunteers can get signed on & get to work immediately!

Thanks for any info you can provide. This will give the TS & their helpers an additional boost in the War on Dale.

Hale YES!

To be fair Poast did research his move and based on the available data he thought his new house was within the district ... it turns out that either through inaccuracies in the data he was given or an error in his interpretation his new house was one or two houses outside of the 32nd.
