The CPD investigation into the WECC's complaint filed against Dale Mallory is nearing completion - One week, two at the most.
The complaint alleges that Dale Mallory illegally took community funds from the WECC bank account three months after his removal from office.
Dale Mallory still hasn't turned over bank account or council records to the community.

I never understood why you (or someone who lives in the West End)didn't file a suit against Dale for the missing WECC funds. Wouldn't that have forced the issue?

Good question, and it's something that many have discussed.
Several factors are in play: 1)Many inner-city folks are paying a $20,000+ legal bill to Tim Mara to beat CityLink. 2)- Some of the same people spent $4,000+ to Newman to win against Dale's 2 frivolus lawsuits. 3)-Many gave to Bolton's campaign 4)-Many will give to Hale's campaign 5)- We want a CRIMINAL conviction first. 6) When the dust settles, we always have civil options. Many are pissed at the harm Dale and Marcus Jenkins have caused. Civil suits are likely AFTER the criminal case is heard.
Anon 12:13 is right on how this stuff should go for maximum effectiveness. A civil proceeding wouldn't necessarily knock Dale out of the picture to take a paid for, cushy seat in Columbus.
There is clear cut criminal wrongdoing, especially what he's done under the canopy of WECC. This is proven & undisputable. The slickest defense attorney in the world won't be able to slice through that.
Speaking of "slick" attorneys, Kenny isn't in the Dominion Building over on Elm Street anymore. The brass plaque has been removed from the outside directory. The Dominion Bldg., as you remember, is owned by Ann Xanders, wife of George Xanders, who is connected with Chris Hurlburt. Hurlburt was the "trustee" of the Linn St. greasy spoon until it landed in Harold Cleveland's portfolio.
It's anyone's guess why Kenny loaded up the truck & moved elsewhere. Pick a guess, throw it against the wall & see if it sticks.
In the end, the TS folks, WECC people & interested supporters are focused on a criminal complaint on Dale. As I said before, that's going to put paid to the election long before the polls open.

If they charged him today he might have to appear in court before the election. In a couple of weeks he should be able to push off any court appearance until after the election.

This notice on The Enquirer blog under lack of respect for the mayor. This will never happen because TimBO has none and ODP lacks coherency to tackle such a request. Do not rest, keep your focus on the choice of the people and how to make sure the real people's choice works this through.

Is there any truth to today's widespread rumor that Dale Mallory is being asked to drop out? Apparently the ODP quietly conducted a poll, and sent the results to Tim Burke that show Dale losing. It's rumored that even the Mayor is now concerned about Dale getting elected while the scandals are investigated because it's potential bad affect on the Mallory name.
1) He's a Mallory
2) He's running for a "Black seat"
and a "family seat"
3) "It's Dale's turn"....Wm Mallory Sr.
4) The CPD "works for the Mayor"

Legal reasons.....we don't need no stinkin reasons.
He should have never taken the WECC to court. Then he wouldn't have to deal with his statement to the judge that he was giving up the fight for the position. That document is giving the police fits, and Dale can't lie his way out of court documents.

Mr. Dallory, the courts & the law work in ways everyone will never be able to figure out. That goes for the brightest, most intelligent attorney out there. Ditto for the very best Judge.
The Grand Jury could toss the case back to Municipal Court, & Dale could get socked with any number of misdemeanors - unauthorized use of property, misdemeanor theft, etc. Then get placed on probation for a year.
However, this stinks like a felony to me. Why? I'd like to think the Prosecuting Attorney handling the Grand Jury is going to play up his family's political connections, being community council president so many years, etc. I'd expect them to play that aspect to the hilt.

That depends. If the police go to the Prosecutor's Office with all this stuff & the evidence is meaty, Deters could decide to go straight for a direct indictment. That way, Dale doesn't appear at the Arraignment Desk in the Justice Center & it gets stretched out. Sometimes, with a direct indictment, Grand Jury decides, a Common Pleas Judge is assigned in a matter of hours & it's off to the races. This isn't going to get stuck on the back burner until after the election.
Again, I believe all we'll need is a Grand Jury Indictment & Dale's party is OVER. DONE. The ODP will get word of it straightaway & they'll burn up Timbo's phone line. He'll sweat like a hog on the way to slaughter.
I think the CPD has their own little plans in mind for full effectiveness. Has it occurred to anyone that they might have already talked with Deters & some of his top guns? That's entirely possible. Very possible. And the boys & girls in Deters' office are plugged into all this business - Lawson, N8, Beatty Crime Family, Cincy EZ, Mallory Mob, Jenkins, Dawson & the rest of the tribe.
Sit back & take it EZ for a short bit. BTW, the Courts are closed on Monday. I want to believe this is all going to play out in favor of those who were injured & justice will be served. Keep your eye on a Grand Jury Indictment.

Sounds like the truth squad is insane. I highly doubt that the Ohio Democratic party is conducting polls. Even if they were, nothing can be done about Dale being in the race. If Dale was to drop out they couldn't replace him on the ticket.
I beleve the term "Truth Squad' was coined by Eve Bolton when anti-Dale picketers were outside of channel 12 during the taping of the Hurley show debate.
Hurley asked if that group worked for her. Her reply was that they were irate city folks that wanted to get the truth out about Dale's support of CityLink.

Do BOE employees take leave of absence like they do in city council and mayors' offices? Or as BOE do they just try and not mix business and politics at BOE? If no answer by Monday will escalate this to Secretary of State (or is that Secretary of Snake now?)with particulars. Never ask, never get answers.

Antares, your message just popped up. On the ODP phone calls, nothing ventured, nothing gained. That's how crooks get by with the stuff they pull. If one isn't willing to pick up the phone & snark about it, it's business as usual. Friends are continuing to tell friends & they're dialling that 1-877 number. Good for you that you were put thru to the Red Fone!
Granted, Dale isn't going to be yanked from the ticket at this late date, but hopefully, there's media monitoring the ODP for a whiff of a Hastert-Foley type scandal. Media spotlight & pressure can do plenty to change a voter's mind.
I think that's what we need to do. This way, when it's said & done, we can tell the pro-Dale people that the voters have spoken. Fair election, people voted according to their personal value systems. And we can count on Dale not stepping up to defend himself. Not at this late date. The damage is done. Getting the media to sniff out more dirt in the way of public opinion & outrage will also help grease the skids on an indictment.

This is a perplexing question & I don't have all the answers. BOE employees conduct isn't like it was in the days of Socko Wiethe. Back then, you could work at the Board & be a Party Ward Chair. No kidding. It was rather open & obvious the party affiliation.
Now, it's a bit toned down, with a few do's & don't's, such as yard signs, Tshirts, bumper stickers, that sort of thing. However, the BOE has an employee who's an old Wiethe holdover, Pam Swafford. And she continues to hand shake with what's left of the old guard, including Daddy Mallory. This leads me to believe that these BOE employees do their day to day, but still hop on campaign bandwagons in a sneaky, somewhat sedate manner. They don't exactly operate in the fashion of other working people, do your job, have a practical sense of support (loyalty) to the company & go home. Party & politics go on a continuous basis at the BOE. I'm not familiar how BOEs operate in other Ohio counties, but I've been very suspicious of the Hamilton County BOE for the past several years.
I'm not certain that these BOE people take leaves of absence like city & county folks do to work on a campaign. Actually, with it being the run up to the Election, it used to be that all vacations, unused time off, etc., were cancelled, as it's all hands on deck. They'd bring in contract help to keep things moving. Although technology has improved things to the point where elections are in question, the BOE might continue to restrict leaves of absence.

Anon 12:40, you have a point about Blackwell not caring. I put in a call this afternoon to Columbus & was told if I have a complaint, I need to file it with the Hamilton County BOE first.
I slammed the phone down, did some thinking & did some research. In the 2004 election, scads of people filed complaints with the Secret[ary] of Snake, only to have them rejected on the basis they didn't contact their BOE.
One wheelchair bound individual couldn't get into the polling place & the poll workers refused to allow her daughter to take a ballot curbside to the car to allow this poor soul to vote. Reason: Ya coulda voted absentee.
Absentee voter didn't receive a ballot. None at all. Reason: Not our fault. Yelp at the post office.
Maybe Dean might give us an assist here in addressing a public letter to John Williams at the BOE in an attempt to get a rational answer. You'll remember how he danced & jogged & skated around the Alicia Reece voting address fiasco.
It's tougher than finding a needle in a haystack looking for simple guidelines for BOE employees - what they can do, what they can do, & who can be paid political campaign workers, what constitutes nepotism, family ties, family plots, & all that.
Screw the Ohio Elections Commission. Daddy Mallory continues to squat on that joke panel. His term expires 12/31/07 & as long as someone can drive him to Columbus & he can still sign his name, he'll have squatting rights.
Besides, those crooked individuals know how to drag out the process on a complaint. Why, it's worse than bringing a 2-bit thug drug dealer to justice.
I suggest the next step up is the Ohio Ethics Committee. Seems logical to me seeing we're dealing with a bunch of slippery, slimey, unethical cads.
Then after the election, hopefully, we'll get some people in the Secretary of State & the Attorney General slots that will be willing to take on this wholesale corruption & break some gonads.

When I saw the Dwarf ranting about the NAACP, the SC flag, the delegation relaxing the boycott & eating dinner in a different establishment, I laughed so hard I started to sneeze. I kept reading to see where the point was or if there was going to be a punch line.

At any rate, I agree with you, Pogo. The Dwarf did a dastardly thing by slapping the keys on the Crackberry & outing all those, ah, lobbyists who sit in the back room with Big Daddy & 3M to make deals over brandy, cigars & pretty play pals.
Dickie, Phil, the Mallorys, Roger Ach, Ron Roberts, Timbo, just to name a few, are in each others' pockets for the next big deal. The Dean exposed Dickie Weiland several months ago. I guess the Dwarf couldn't get his brain in comprehension mode on that one.
The day's coming when the Dwarf will have to suck on the fuzzy end of the lollypop & it isn't going to taste great.
