Cincinnati police looking into Dale Mallory impeachment
To my knowledge, Dan Monk of the Cincinnati Business Courier has been the only one to write about Dale Mallory cutting checks and closing down the West End Community Council bank account four months after being impeached.
The Cincinnati Police have been investigating this matter for three weeks. It is a hot potato. If you didn't know, Dale's brother happens to be Cincinnati Mayor Mark Mallory.

Dale Mallory cut checks and closed down the West End Community Council bank account on June 1st, four months after being impeached and removed from office by over 75% of the vote of the West End Community Council.
The fact that he cut the checks and closed down the account is not in dispute. What is now in dispute is Dale Mallory's last chance for freedom. He is claiming that he wasn't really impeached, and that he is still President of the West End Community Council.
Let's take a look at that.
As President of the West End Community Council, Dale Mallory didn't have the authority to cut checks or close down the bank accounts. That is in the bylaws which are on file at Invest In Neighborhoods (which is also currently undergoing an audit).
The authority to cut checks rests with the treasurer, and disbursements need to be ratified by the body of the West End Community Council. Dale Mallory had no authority.
Dale Mallory has claimed that the disbursements were ratified by the WECC body in February, the same month that he was impeached and removed from office.
Dale Mallory didn't preside over that meeting, and the only topic on the agenda was his own impeachment. Channel 12 was there. The Enquirer was there, and citizens also taped the event. A record exists and Dale Mallory is lying.
Let's now look at Dales own words...

"Dale Mallory stated that he "has no intent of remaining President of the West End Community Council" and that "he is respectfully dismissing this matter [the lawsuit] without prejudice."
On April 24, 2006, Dale Mallory stated that he had no intent on remaining President of the West End Community Council. That isn't hearsay, that is what Dale Mallory told a court of law. He openly admitted for the record that he was giving in and he wouldn't fight the impeachment, and that he had no intent of holding the office.
Two months later in June, Dale Mallory was cutting checks and closing down bank accounts of the West End Community Council. In his own defense, he is now claiming that he is still President of the West End Community Council.
Unbelievable.
This is Dale Mallory's last chance for freedom in this world. He needs to convince the Cincinnati Police Department that he is still President of the WECC, months after being impeached. He needs to get his brother, Cincinnati Mayor Mark Mallory, to pressure people to drop the case.
If he can't do that, he is going to be under criminal investigation for cutting those checks. And like I stated earlier, the fact that he cut those checks and closed down the account is not in dispute, even by Dale Mallory.
Dale Mallory is going to jail. If he doesn't, we need to take a cold hard look at the CPD and the officers running the investigation. This will not be allowed to whither and die on the vine. It is not going to go away. They have taken the better part of a month and they still haven't subpoenaed the records. The Mallory Clan is pressuring them to invalidate the impeachment, despite Dale's own admission.
I have faith that the CPD will do the right thing. The law is the law, and it is that simple. May God Bless the Boys (and Girls) in blue.

The Cincinnati Police Department has assigned two detectives in its financial crimes unit to look into circumstances surrounding the February impeachment of West End Community Council President Dale Mallory.
Sgt. Jamel Smith said the review will include whether members followed the proper procedures in impeaching Mallory and whether Mallory, brother of Cincinnati Mayor Mark Mallory, improperly spent community council funds after the impeachment.

This is an excellent overview of the facts.
One additional factoid: Dale Mallory's quote
"Dale Mallory stated that he "has no intent of remaining President of the West End Community Council" and that "he is respectfully dismissing this matter [the lawsuit] without prejudice." was faxed to defense attorney Newman's office at the time of the scheduled DEPOSITION. A prior deposition was cancelled by Dale's side. Dale would NEVER TESTIFY UNDER OATH!
Dale ran away from his case against Colbert/WECC because he knew he would face questions he could never answer under oath.
Dale painted himself in a corner. His position is that the impeachment is invalid. The place to argue that position is in court. Dale had 2 court cases. Dale withdrew one case and he lost the other.
Dale cannot hope to win a court case without testifying in a deposition. Dale has woven a series of lies that contradict themselves.
1)He said he was nuetral on CityLink
2)He denied his meetings that were promoting CityLink
3)the things he denied above, he billed the EZ for.
4)he billed the EZ to run WECC meetings.
5)he lies to police when he claims WECC approved the "y" check in February. There were 300 witnesses and video that proove this as a lie.
You get the picture. Dale has lied himself into a corner that he can't escape. He tells more lies to the press and to police, but the TRUTH SQUAD has all the records of the court documents filed by Dale and sworn to by Dale that contradict his new story. Lieing to police in a police investigation is a crime. Just one more reason Dale should go to jail.
The Mayor needs to be VERY careful. He is doing all posible to make this go away. He is putting pressure on Council to make it go away. He will put pressure on Dahoney and the police. If the mayor uses his power to influence this CRIMINAL investigation aqainst his brother, the Mayor will be committing a crime. The Mayor's moves will be watched by the Truth Squad. The Mallory Machine will be destroyed if they use their City Hall power to try to cover up this case against criminal Dale.

Don't forget that co-defendant HARCUS JENKINS claimed he lived at 925 Dayton Street, the boarded up house that Dale owns but won't pay taxes on. Marcus didn't live there or anywhere in the West End.
Marcus was on the EZ invoices submitted by Dale.
This Marcus/Dale connection is part of a fraudulant court document and a conspiracy (RICO?).
While the Truth Squad has pointed this out in the past, this is a danger for the Mallory Mafia that won't go away.

I still have Jail4Dale's campaign mailers that were sent out before the May Primary. One clearly states about being president of community council, the other one revised. These will be held until such time as they are no longer needed.
The Mallorys have no business impeding a police investigation, but, that's what they are in business to do - we're talking the black Kennedys here, pages taken right out of that era of history.
While I trust the CPD to do the right thing, I'm highly confident Joe Deters has his boys & girls drawing a perfect bead on this entire situation.
And 3M does not want to meddle in police affairs. He does not want to sicc Dahoney loose on this right out of the gate. City Council does not want to waffle on any part of this. A phrase not heard in this City could very well come into play here - NO CONFIDENCE REFERENDUM. They do it in Europe & other countries at least once a week & we can take up the charge.

The CPD should know all about it. HE SUED THE DAMNED POLICE DEPARTMENT.

What a transistion that would be. From a sure seat in the Statehouse to an 8x10 in the bighouse. You bet the Mallory's are fighting this one hard. The police haven't done anything in a month because they are scared shitless.
You can bet that paycheck 3M & Big Daddy are buttonholing everyone & anyone they can on this, doing Kennedy Family damage control. (They've never had to do that before, so Daddy had to go to the Library & get the definitive edition on the Kennedys to see how they cleaned up their dirty laundry.)
The police have been very quiet & City Council is breathing a sigh of relief, seeing the auditors will be on the front lines. Also, Council is technically on break for a month.
I'm really concerned. It's too bad we can't pause for one second to enjoy a bit of the Summer, as it's going to be high alert until some of the investigation starts to trickle out.
In no way are we going to let City Council crayfish their way out of this & it is our responsibility to hold them accountable if anything goes wrong. I'm praying that the proof is on our side, which it is.

Although there are those on city council that are receiving substantial heat on this, rest assured they will not let it die. It is because of the actions of those few council members that the EZ is being audited in the first place both by an outside agency and HUD. Remember too, despite heat from 3M to back off the perceived Mallory witch hunt, the city has a right to request (and pursue legally) the WECC bank account records (that Dale Mallory refuses to relinquish) because the WECC is a recipient of IIN funds. Bank account records can not disappear and the city is prepared to pursue the records need be.
I got word today that the Attorney General is next at bat and prepared to get on board. He's batting for a grand slam.
Interesting, the democrats are beginning to see the light and reorganize themselves. A group made up of precinct executives has suggested, and now continues to pressure, Tim Burke to remove Dale Mallory as democratic candidate for State Representative this November. Burke’s response has been one of denial causing eyebrows to rise. Burke’s refusal to act has caused the group to discuss finding a replacement for Burke himself. Watch for a contest to appear between Burke's loyalties to the Mallory Family, et. all verses his constituents. Icing on the cake.

Mr. Dawson voted the EZ/Citylink way in the February zoning appeal that CityLink lost 3-2. Had Thadius properly recused himself the vote would have been 3-1 AGAINST CityLink.
There is a ton of evidence that Thadius owed his soul to the EZ and these EZ connections will be a key topic of Truth Squad discussion next week.
Let's hope the EZ audit, the police and the FBI follow up on this criminal activity by Thadius.

The 3-2 v. 3-1 vote is important because 1/2 of Timmy Burke's appeal case is just how "close" the vote was.
A better frame is that the zone board was packed with a CityLink/EZ
paid SHILL and CityLink STILL LOST their damned case.
The community DOES NOT SUPPORT CITYLINK!!! Why not even the playing field? Have the Feds give the Tim Mara side the same number of fed dollars that were used to support CityLink?
Granted, the City is now spending dollars to defend the zoning, but the proven EXPERT here is Tim Mara. Why not use those city dollars wisely and pay Tim Mara for the best defense of the February ruling?

the West End Community Council has learned that’s the only way to defend against a Mallory. It’s a pain in the ass with the lawsuits and then having to shut down the Mallory Mafia EZ piggy bank, but it’s worth it!
